1. Agreement

1.1 By placing an order on the website http://www.bagelsbeans.nl, you accept the offer from the franchisee of Bagels & Beans B.V. where you will pick up your order, and you enter into an agreement with this franchisee. This franchisee will prepare your order and have it ready at your chosen time. Any questions and/or comments should therefore be directed to the respective franchisee. You can find the contact details of the relevant franchisee on the website www.bagelsbeans.nl//over/vestigingen. The confirmation email you receive after placing your order will confirm the selected pickup time and location. Payments for orders are made at the store where the order is picked up. Bagels & Beans B.V. and/or its franchisees may hereafter also be referred to as Bagels & Beans.

1.2 As part of this agreement, Bagels & Beans B.V. and its franchisees process personal data. This is always done in accordance with applicable laws and regulations. For more information about how your personal data is handled, please refer to our privacy statement.

1.3 Bagels & Beans B.V. and its franchisees will never transfer your personal data to third parties without your consent.

2. Pickup

2.1 Orders placed via bestel.bagelsbeans.nl can be picked up at a location of your choice. Some locations have chosen to offer delivery themselves.

2.2 Orders can be placed online up to 15 minutes before closing time of the respective store. The opening hours are listed on the store locations page.

2.3 While we strive to have your order ready at the selected pickup time, circumstances such as store busyness may cause delays.

2.4 The risk regarding the order transfers to you once the order has been picked up and paid for.

2.5 If you are dissatisfied with a non-food item you picked up (e.g., tableware or a jute bag), you may return or exchange the item at the store where it was purchased, provided that it is unused, in its original packaging, and accompanied by the original receipt.

3. Promotional Offers

3.1 Any promotional offers must be applied during the ordering process. If this is not done, Bagels & Beans B.V. and its franchisees cannot be held responsible for applying the promotion afterward.

3.2 Bagels & Beans B.V. and its franchisees reserve the right to reject or withdraw promotional offers at any time.

3.3 We may send offers or product/service information that we believe may be of interest to you (via email, but only if you give consent when placing an order at bestel.bagelsbeans.nl).

4. Payment

4.1 When ordering food products via bestel.bagelsbeans.nl, payment in advance is possible via iDEAL or credit card. These transactions are processed through the secure platform of our payment partner MultiSafePay B.V.. For questions or comments, contact hallo@bagelsbeans.nl.

4.2 Bagels & Beans may expand payment options in the future. Any new payment methods will be announced on our website. Refunds are issued via the same payment method used for the order (such as iDEAL). Refunds are processed within 3 business days after receiving the returned items (gift and loyalty cards cannot be returned).

4.3 Payments for purchases on our webshop **(https://giftcard.urdsolutions.nl/bagels/)**—which sells only coffee beans for home or office—can be made via iDEAL.

4.4 URD Solutions handles the financial processing of all webshop orders.

5. Prices

5.1 All prices are listed in Euros (€), in compliance with legal regulations, and include VAT unless stated otherwise.

5.2 Special promotions are only valid while supplies last.

5.3 The price communicated by Bagels & Beans in the order confirmation is binding. Any obvious pricing errors (e.g., incorrect price listings due to manipulation or mistakes) can be corrected by Bagels & Beans, even after the agreement has been established.

5.4 Delivery fees apply to consumer orders under €50, unless stated otherwise. Special rates apply for deliveries outside the Netherlands. Some payment methods may have additional conditions related to delivery methods and associated costs. These details will be clearly communicated to the consumer.

6. Delivery and Delivery Time

6.1 Bagels & Beans exercises the utmost care when processing and fulfilling orders.

6.2 Orders placed on the webshop (https://giftcard.urdsolutions.nl/bagels/) are delivered as soon as possible. Orders placed before 5:00 PM on a business day are typically shipped within 3 business days, with a maximum delivery period of 30 days. These times are estimates and not legally binding.

6.3 Once the products are delivered to the specified address, the risk transfers to the recipient.

6.4 Different conditions may apply for international deliveries.

7. Complaints and Defects

7.1 After receiving an order via bestel.bagelsbeans.nl or our webshop, the recipient must inspect the products immediately. Complaints about defects or incorrect deliveries must be reported within 7 days after receipt.

8. Cooling-Off Period, Withdrawal, and Returns

8.1 You have the right to cancel a merchandise order from our webshop within 14 days of receipt without providing a reason. After cancellation, you have 14 additional days to return the product. The full order amount, including shipping costs, will be refunded. The return shipping costs will be covered by Bagels & Beans. Products must be returned in their original condition and packaging.

9. Intellectual Property Rights

9.1 All intellectual property rights related to the website http://www.bagelsbeans.nl and its content, including packaging and promotional materials, belong exclusively to Bagels & Beans B.V., its affiliated companies, and/or suppliers. These rights include trademarks, trade names, domain names, patents, database rights, and copyrights. You are not permitted to modify, copy, reuse, or remove any brand logos, copyright notices, or other proprietary marks on the website or products.

10. Liability

10.1 The total liability of Bagels & Beans B.V. and its franchisees for any attributable failure is limited to direct damages, up to the amount paid for the order.

10.2 Liability for indirect damage, loss of profit, or missed savings is excluded.

11. Governing Law

11.1 Agreements between Bagels & Beans B.V., its franchisees, and you are governed by Dutch law and will be settled by the competent court in Utrecht.
